A report released by Florida authorities revealed that a five-year-old girl fell off a Disney Dream cruise ship in June while posing for a photo on a porthole railing at her mother’s request. The Broward County Sheriff’s Office deemed the incident “avoidable” and filed the report the day after the child fell overboard while the ship was returning from the Bahamas to Port Everglades in Fort Lauderdale.
The mother’s actions in facilitating the photo were described as “arguably negligent and irresponsible” in the state attorney’s report but did not meet the criteria for criminal charges. The incident, which gained international attention, saw both the child and her father being rescued by cruise ship staff and was captured in dramatic videos shared on TikTok.
Security footage indicated that the family was on deck four when the mother gestured toward the railing where the child was sitting. The child lost her balance and fell approximately 49 feet into the water, prompting her father to jump in after her about 45 seconds later.
The ship’s rescue boat successfully retrieved both individuals from the water by 11:49, with the child suffering from hypothermia and her father sustaining a spine fracture. The father recounted in a police interview from his hospital room that his wife had paused to take a photo of their daughter on the railing before the accident occurred.
Although the fall was deemed “avoidable” by police, the Broward County State Attorney’s Office decided not to press charges, stating that while the mother’s conduct was negligent, it did not constitute criminal negligence. The case was subsequently closed without any charges being filed.
Passenger falls overboard are uncommon, with statistics showing that between 2009 and 2019, only 0.00004% of passengers and crew members experienced such incidents. Out of 212 reported overboard cases during that period, 28% were rescued, and investigations revealed that the majority were due to intentional or reckless acts.
