Vancouver Resident Files Class Action Lawsuit Against StubHub

Mark Gallagher, a Vancouver resident, has taken legal action against StubHub by initiating a proposed class action lawsuit representing ticket buyers in Canada. He expressed his frustration with StubHub after the ticket resale platform canceled his World Cup tickets, along with those of numerous soccer fans. Gallagher, who had purchased an $11,407 pair of prime seats for the Canada vs. Qatar game in Vancouver, was left ticketless despite repeated assurances from StubHub leading up to the event. Seeking punitive damages, he alleges that StubHub engaged in deceptive practices by selling tickets they knew they could not honor.

This marks the first class action claim filed in Canada against StubHub following similar legal actions in New York and California related to the mass cancellation of World Cup tickets by the company. Despite StubHub’s FanProtect Guarantee promising refunds or replacement tickets within five business days, many customers have faced significant delays and challenges in obtaining compensation for various events. StubHub’s response to inquiries about its refund and dispute policies has been vague, emphasizing their commitment to ensuring fans attend events but failing to address specific concerns.

Notably, StubHub’s policies do not cover travel or accommodation expenses incurred by customers, as highlighted by cases such as Kelly Mongillo’s experience of spending thousands on travel costs only to have her World Cup tickets canceled by StubHub without adequate compensation. The company’s Global User Agreement includes clauses that restrict customers from pursuing legal action beyond seeking ticket refunds, further complicating the resolution process for affected individuals.

Customers like Jennifer Hale and Denis Radetic have faced prolonged waits for refunds from StubHub, prompting some to resort to legal action for resolution. StubHub’s arbitration process has been criticized for its complexity and lack of transparency, with instances where customers have struggled to navigate the system to seek recourse for canceled tickets. Additionally, it has been revealed that StubHub profits from canceled transactions by charging sellers for the full ticket price, even in cases where they did not deliver the tickets.

Furthermore, customers like Jeff Ripley have raised concerns about StubHub holding onto customers’ money for extended periods, potentially earning interest on these funds without providing adequate refunds for canceled tickets. Ripley highlighted the need for accountability in how StubHub handles customers’ money and called for closer scrutiny of the company’s practices in managing ticket sales and refunds.
