Man Found Not Criminally Responsible for Cousin’s Death

A man from Hamilton who fatally stabbed his cousin in 2023 has been deemed not criminally responsible by an Ontario judge on Wednesday. Laureano Bistoyong was found to have caused the death of Mark Bistoyong due to a mental disorder, according to Superior Court Justice Andrew Goodman.

The ruling sparked an emotional reaction from family members and supporters present in the courtroom, leading to disruptions and outbursts. The Ontario Review Board will now review the case to determine the next steps for Laureano within approximately 45 days, during which he will remain in custody at St. Joseph’s Healthcare.

Following the verdict, Mark’s mother, Merl Bistoyong, expressed her disappointment and disgust, stating that she believed the decision was not a form of justice but rather a crime. Laureano, who had a different appearance compared to earlier court appearances, was convicted of second-degree murder in October 2024 for fatally stabbing Mark during a family barbecue in July 2023.

During the trial, it was revealed that Laureano, also known as Lawrence, was involved in a basketball game with Mark, leading to the tragic event. Although there were conflicting arguments about Laureano’s intent, the Crown contended that the act was premeditated, while the defense claimed it was impulsive and unintentional.

Expert testimony from forensic psychiatrists highlighted Laureano’s mental health issues, particularly schizophrenia, which impaired his ability to distinguish right from wrong during the incident. The court accepted the medical evidence, acknowledging Laureano’s mental state at the time of the crime.

Throughout the trial, strong emotions were evident, with supporters of Mark’s family showing solidarity by wearing clothing items in his memory. The courtroom atmosphere became tense as the judge delivered the verdict, resulting in disruptions and police intervention.
