Senator Mark Kelly Sues Pentagon Over Free Speech

Democratic Senator Mark Kelly filed a lawsuit against the Pentagon on Monday, alleging that the Trump administration violated his free speech rights by attempting to punish him for speaking out against illegal orders given to U.S. troops. Kelly, a retired astronaut and former U.S. navy pilot representing Arizona, is challenging his censure by Defense Secretary Pete Hegseth last week. Hegseth’s censure, announced on Jan. 5, could potentially lead to a demotion from Kelly’s retired captain rank and a reduction in retirement benefits.

In response, Kelly has requested the federal court in Washington, D.C., to declare the censure, rank-related proceedings, and any other potential punishments as unconstitutional and unlawful. The lawsuit asserts that the First Amendment protects legislators like Kelly from reprisals related to their public policy statements.

The legal action taken by Senator Kelly against the Defense Secretary is considered unusual, highlighting the ongoing power struggle between members of Congress and the executive branch. The censure was triggered by Kelly’s involvement in a video with fellow Democratic lawmakers in November 2025, where they urged troops to resist unlawful commands and uphold the Constitution.

Despite facing criticism from President Trump, who labeled their message as seditious, Kelly and his colleagues have stood firm in their stance. Following the video’s release, the Pentagon initiated an investigation into Kelly, citing a law that permits retired service members to be called back to active duty for disciplinary actions.

While all lawmakers in the video have military or intelligence backgrounds, Kelly is the focus of the investigation due to his formal retirement status under the Pentagon’s jurisdiction. The lawsuit names Hegseth, the Defense Department, navy Secretary John Phelan, and the navy as defendants. Kelly emphasized that his legal action aims to protect the rights of Americans who have defended the nation’s freedoms, condemning Hegseth’s alleged attempts to stifle dissent among military veterans by threatening their ranks and benefits.
