“Weinstein Rape Charge Dropped Amid Accuser’s Testimony Refusal”

Harvey Weinstein will not be retried for a rape charge in New York after prosecutors decided to drop the case due to the accuser’s unwillingness to testify again. This decision comes after the accuser, Jessica Mann, expressed her inability to go through another trial.

While Weinstein remains convicted of other sexual offenses in New York and California, the rape charge in New York had been pending following a previous conviction that was overturned and two mistrials.

Mann, a hairstylist and actor, testified in all three trials, alleging that Weinstein had raped her in a Manhattan hotel in 2013. The producer denied the accusation, claiming that their interactions were consensual.

In a letter read in court by prosecutor Nicole Blumberg, Mann stated that she could not continue with the case, mentioning the emotional toll it had taken on her over the past eight years. Blumberg praised Mann’s courage but acknowledged her decision to dismiss the case given her current feelings. The judge subsequently dismissed the charge.

Weinstein, who showed no visible emotion, returned to jail awaiting sentencing in September for a separate sexual assault conviction in New York. Prosecutors are seeking a 20-year prison sentence for this conviction.

After completing his sentence in New York, Weinstein faces a 16-year term in California for a rape conviction involving another woman. He is currently appealing both convictions.

Weinstein’s legal team expressed relief at the dismissal of Mann’s allegation, stating that the charges were unwarranted and that he maintains his innocence.

Mann testified about her on-and-off relationship with Weinstein, emphasizing that she had repeatedly tried to end the relationship and refused his advances during the incident in 2013. She described feeling cornered and intimidated by Weinstein in the hotel room.

The latest trial took a toll on Mann, who struggled with health issues during her testimony, including a concussion, headaches, and disassociation. She expressed her frustration and trauma in a letter to the court, criticizing the justice system and media for their handling of her case.

Weinstein, once a powerful figure in the film industry known for producing acclaimed movies, faced a downfall following multiple sexual assault allegations in 2017. These allegations led to criminal charges in New York and Los Angeles, marking a turning point in the #MeToo movement.

While Weinstein has been acquitted of some charges, he was convicted of raping Mann in 2020 before the verdict was later overturned. Subsequent retrials ended in deadlock.

Weinstein, aged 74, did not testify in any of the trials but maintained that his encounters with accusers were consensual. He has faced criticism and legal battles as he continues to deny allegations of assault.

The Associated Press refrains from naming individuals who report sexual assault unless they choose to be identified, as in Mann’s case.
