“Woman of Tataskweyak Cree Nation Sues Winnipeg Police for Partner’s Death”

A woman from the Tataskweyak Cree Nation has initiated legal action against the City of Winnipeg and two police officers following the death of her common-law partner after an incident involving Winnipeg police. Elias Whitehead, aged 37, encountered officers near Sherbrook Street and Broadway in Winnipeg on October 15, 2023. The Independent Investigation Unit of Manitoba, investigating Whitehead’s death while in police custody, stated that officers responded to a report of a man behaving erratically in traffic in the West Broadway area before 11 p.m.

During his arrest, Whitehead experienced breathing difficulties and was provided medical attention by Winnipeg Fire Paramedic Service personnel who were in the vicinity responding to an unrelated incident. He was subsequently taken to Health Sciences Centre, where he was pronounced deceased. Eyewitness footage captured Whitehead’s arrest, showing a sequence of events leading up to his death.

In a recently filed claim at the Court of King’s Bench in Winnipeg, Jody Beardy, Whitehead’s common-law partner, alleged that an officer identified as Pat Doe escorted Whitehead, who was compliant and unarmed, to a police vehicle. The claim asserts that Whitehead was forcefully handled by the officers, resulting in fatal injuries. The lawsuit contends that Whitehead posed no immediate threat and accuses the officers of using excessive force without consent or justification.

The lawsuit further alleges that the officers, aware of Whitehead’s Indigenous background, subjected him to differential treatment based on his race, leading to fatal consequences. Beardy, a teacher from the Tataskweyak Cree Nation, located over 700 kilometers north of Winnipeg, seeks damages on behalf of herself and Whitehead’s family members.

The claims made in the lawsuit have not been tested in court, and the City of Winnipeg has yet to respond with a statement of defense. The Winnipeg Police Service declined to comment on the ongoing legal matter. Beardy’s legal representative, Martin Pollock, expressed the profound impact of Whitehead’s death on his client and highlighted the distress caused by witnessing the video footage of the arrest.

The attorney emphasized the shock and anguish experienced by Beardy upon seeing her loved one subjected to force while in a defenseless position, leading to his tragic demise. Pollock raised poignant questions about the necessity and consequences of the force used during Whitehead’s arrest, urging contemplation on how the situation could have unfolded differently.
